These terms and conditions of sale are entered into, on the one hand, by Anaerialhoopandco, represented by Ana\u00efs Oliva, whose registered office is at 465B Route du Croibier, 73330 Le Pont-de-Beauvoisin, France, registered with the Lyon Trade and Companies Register under number 888 445 392, hereinafter \u201cthe Seller\u201d, publisher of the website anaerialhoopandco.com, and, on the other hand, by any natural person purchasing via the website anaerialhoopandco.com for personal use, hereinafter \u201cthe Buyer\u201d.<\/p>\n\n\n\n

Article 1. Purpose<\/h2>\n\n\n\n

These terms and conditions define the rights and obligations of the parties for the online sale of the products offered on the website anaerialhoopandco.com. Placing an order implies unreserved acceptance of these terms, which the Buyer acknowledges having read before ordering. The applicable terms are those in force on the date of the order.<\/p>\n\n\n\n

Article 2. Products<\/h2>\n\n\n\n

The products offered are those presented on the website, while stocks last. Each product comes with a description of its essential characteristics (format, number of pages, dimensions\u2026). Photographs are as faithful as possible; slight colour differences may however appear depending on the screen used.<\/p>\n\n\n\n

Article 3. Prices<\/h2>\n\n\n\n

Prices are shown in euros. VAT not applicable, art. 293 B of the French General Tax Code.<\/strong> Prices do not include delivery costs, which are shown to the Buyer before the order is confirmed. The Seller reserves the right to change prices at any time; the applicable price is the one displayed when the order is placed.<\/p>\n\n\n\n

Article 4. Ordering and payment<\/h2>\n\n\n\n

The Buyer selects the products, adds them to the basket, enters their details and the chosen Mondial Relay pick-up point, reviews the total amount (products and delivery costs), accepts these terms and then confirms the order with an obligation to pay.<\/p>\n\n\n\n

Payment is made securely online via PayPal, with a PayPal account or by credit or debit card. The Seller never has access to the Buyer's bank details. The order is definitively recorded once payment has been accepted; a confirmation is then sent to the Buyer by email.<\/p>\n\n\n\n

Article 5. Retention of title<\/h2>\n\n\n\n

The products remain the property of the Seller until the price has been paid in full.<\/p>\n\n\n\n

Article 6. Delivery<\/h2>\n\n\n\n

Products are delivered by Mondial Relay to pick-up points in mainland France, Belgium, Luxembourg, Spain, Italy, Portugal, Germany, the Netherlands and Austria; when ordering, the Buyer indicates the pick-up point of their choice. For other destinations, products are delivered to the Buyer's home by Colissimo. Delivery costs are shown before the order is confirmed; Mondial Relay delivery is free for orders of \u20ac100 or more. Orders are shipped within one week of payment confirmation, when the products are in stock; a tracking number may be sent by email. Unless otherwise agreed, delivery takes place no later than 30 days after the order; failing that, the Buyer may cancel the sale under the conditions set out in articles L216-2 et seq. of the French Consumer Code and be refunded.<\/p>\n\n\n\n

The risk of loss or damage to the products passes to the Buyer when they take physical possession of them. If the parcel is damaged, the Buyer is invited to record reservations with the pick-up point and to inform the Seller as soon as possible.<\/p>\n\n\n\n

Article 7. Right of withdrawal<\/h2>\n\n\n\n

In accordance with articles L221-18 et seq. of the French Consumer Code, the Buyer has 14 days from receipt<\/strong> of the products to exercise their right of withdrawal, without having to give any reason. They notify their decision by email to contact@anaerialhoopandco.com<\/a>, by means of a clear statement or the withdrawal form provided in the appendix.<\/p>\n\n\n\n

The Buyer returns the products, in their original condition, within 14 days of notifying their decision; return costs are at their expense. The Seller refunds all sums paid, including the initial delivery costs (based on the standard delivery method), within 14 days of receiving the withdrawal decision; the refund may be deferred until the products have been received back or proof of their dispatch has been provided. The refund is made using the same payment method as the one used for the order.<\/p>\n\n\n\n

Article 8. Legal guarantees<\/h2>\n\n\n\n

All products automatically benefit from the legal guarantee of conformity<\/strong> (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects<\/strong> (articles 1641 et seq. of the French Civil Code). Under the legal guarantee of conformity, the Buyer has two years from delivery of the product to take action; they may request repair or replacement of the product or, failing that, a price reduction or cancellation of the sale. Under the guarantee against hidden defects, they have two years from discovery of the defect.<\/p>\n\n\n\n

For any complaint, the Buyer contacts the Seller at contact@anaerialhoopandco.com<\/a>.<\/p>\n\n\n\n

Article 9. Liability<\/h2>\n\n\n\n

The Seller cannot be held liable for non-performance of the contract in the event of force majeure, nor for damage resulting from the use of the Internet (service interruption, intrusion, viruses\u2026).<\/p>\n\n\n\n

Article 10. Intellectual property<\/h2>\n\n\n\n

All elements of the website anaerialhoopandco.com and of the products (texts, photographs, logo, visuals, content of the book and posters) are the exclusive property of the Seller or its partners. Any reproduction, even partial, is prohibited without prior written authorisation.<\/p>\n\n\n\n

Article 11. Personal data<\/h2>\n\n\n\n

The personal data collected when an order is placed (name, email, telephone, pick-up point) are necessary for processing and delivering it. They are used only by the Seller and its service providers (payment, transport) and kept for as long as necessary for these purposes and legal obligations. In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, the Buyer has the right of access, rectification, erasure, restriction, objection and portability, which they can exercise at contact@anaerialhoopandco.com<\/a>. They may also lodge a complaint with the CNIL (French data protection authority). See also our privacy policy<\/a>.<\/p>\n\n\n\n

Article 12. Complaints and disputes<\/h2>\n\n\n\n

For any complaint, the Buyer contacts the Seller at contact@anaerialhoopandco.com<\/a> in order to seek an amicable solution.<\/p>\n\n\n\n

Article 13. Applicable law<\/h2>\n\n\n\n

These terms and conditions are governed by French law. In the event of a dispute, and failing an amicable solution, the French courts have jurisdiction; a consumer Buyer may bring proceedings before the court of their place of residence.<\/p>\n\n\n\n
